On June 16, 2023 Wharton BDAP organized the first Reg@Tech Roundtable on Digital Assets in Europe. It took place in Vienna, Austria and was hosted and supported by Schoenherr Attorneys at Law.
The roundtable covered a variety of topics. The morning session was focused on general policy trends and their impact on the crypto industry, regulation and trends in Europe and the US, and whether EU’s MiCA framework is a curse or a blessing for Europe. We rounded up the morning session exploring key regulatory challenges, comparing the “regulation by enforcement” approach in the US to the regulatory frameworks in Europe, and their impact for global crypto businesses.
The afternoon session dealt with ownership of digital assets from a common law and civil law perspective, custody of digital assets, the treatment of digital assets in case of insolvency, and data-driven analysis of solvency of VASPs.
